Conference: Contentious-administrative mediation, an opportunity for public administrations

Introduction

Mediation in the contentious-administrative field is a valuable opportunity for public administrations, offering an alternative and effective way to resolve conflicts. The mediation process, supported by the court, offers a space for confidential, flexible and participatory dialogue, where all possible solutions can be explored, respecting the principle of legality. It also facilitates the resolution of often deadlocked situations, maintaining control over the solution, fostering a culture of collaboration and understanding, which allows citizens to feel heard and closer to the different administrations.

Mediation is a useful and effective tool for addressing numerous issues in public administrations, simplifying their resolution, with a lower economic, social and personal cost. And, at the same time, it is an opportunity to contribute to pacifying conflicts and reducing the use of unnecessary resources and executions by offering a space for consensus between the parties, showing a better, closer and more efficient public service.

Objectives

  1. To raise awareness of the use of administrative and contentious-administrative mediation from the opportunity it represents for public administrations, with a global perspective, both theoretical and practical.
  2. Know the regulatory framework, what, how, when and where to refer to mediation.
  3. Provide training in recognizing when mediation is a viable and beneficial option.
  4. Sharing experiences of mediation in Spain, with special reference to Madrid.
  5. To learn about the experience of the Intrajudicial Mediation Unit (UMIM) of the High Court of Justice (TSJ) of the Region of Murcia.
  6. Understand the role of the mediator and the legal profession in mediation, developing communication and negotiation skills.
